Online policies.

THIS POLICY CONTAINS INFORMATION PERTAINING TO ERVIN & SMITH INFORMATION PRACTICES. This is the Ervin & Smith Privacy Policy, which applies to the Ervin & Smith Web site (“site”) and Ervin & Smith social media sites. It explains what information we collect when you use our site, how we collect information, how we use information and how you can manage that information. We pledge to strictly follow the Privacy Policy below, as well as all applicable United States laws and regulations, including privacy laws.

Changes in our privacy policy.

Ervin & Smith reserves the right, in its sole discretion, to amend this Privacy Policy. The most current version of our Privacy Policy, available on our site, will supersede all previous versions. You should check our site regularly for the latest version and discontinue use of the site if you do not agree with any of the terms.

Information we collect.

There are different types of information that we collect on the Ervin & Smith website:

  • Personal information: Through our contact forms and blog, we collect personal information that you provide to us. The information we keep in our system includes:
  • Contact information: business name, first name, last name and email address.
  • General comments and information: Our Web site offers a publicly accessible blog. If a user chooses to disclose personally identifiable information through this area, all information may be collected and viewable by others.
  • Activity and technology information: We may collect information about members’ usage of our site, including what pages and areas you use on our site, your IP
    address, which web browser you use and dates and times of your visits.

How we collect information.

Some of the information we collect is given to us directly by users through our contact forms and Ervin & Smith social sites. We will also keep any information you provide to us when you contact us directly by email, phone or mail. In addition, information is automatically collected through technology on our Web site, including through the use of tracking technologies like cookies, anonymous identifiers, metadata, Web beacons and software tools.

Cookies: A cookie is a small text file that is stored on a user’s computer for record-keeping purposes. We use cookies on this site. We do not link the information we store in cookies to any personally identifiable information you submit while on our site. We use both session ID cookies and persistent cookies. A session ID cookie expires when you close your browser. A persistent cookie remains on your hard drive for an extended period of time. Our third-party tracking technologies use persistent cookies to anonymously collect usage statistics. You can remove persistent cookies by following directions provided in your Internet browser’s Help file. If you reject cookies, you may still use our site, but your ability to use some areas of our site may be limited.

Log Files: As is true of most sites, we gather certain information automatically and store it in log files. This information includes Internet protocol (IP) addresses, browser type, requested page, operating system and date/time stamp. We use this information, which does not identify individual users, to analyze trends, to administer the site and to resolve errors. We link this automatically collected data to Personally Identifiable Information only for the purposes of investigating fraudulent use of our site.

Flash LSOs: Third-parties use local-shared objects on our site, also known as Flash cookies, to display content through the Flash player. Flash cookies are different from browser cookies because of the amount of, type of, and how data is stored. Cookie management tools provided by your browser will not remove Flash cookies. Third-Party Analytics/Tracking: The use of cookies by our tracking utility company is not covered by our Privacy Policy. We do not have access to or control over these cookies. Our tracking utility company and service providers use session ID cookies to make it easier for you to navigate our site, in order for you to use the shopping cart, etc. Our third-party partners employ clear gifs (a.k.a. Web beacons/Web bugs), images, log files and scripts that help them better manage content on our site. We do not tie the information gathered to our customers’ or users’ Personally Identifiable Information.

Use of information.

Information collected from users will be used to:

  • Provide customized content.
  • Provide you with Ervin & Smith products and services that you request and that we think will be of value to you.
  • Improve our products and services.
  • Send you offers and promotions from us, only if you opt in to our marketing programs.

Additional use of information.

In addition to the above, we use the information we collect to provide, maintain, protect and improve our Web site and services, to develop new ones and to protect Ervin & Smith and our users. We will share personal information with companies, organizations or individuals outside of Ervin & Smith if we have a good-faith belief that access, use, preservation or disclosure of the information is reasonably necessary to:

  • Meet any applicable law, regulation, legal process or enforceable governmental request;
  • Enforce applicable Terms of Service, including investigation of potential violations;
  • Investigate a violation of our Terms of Use, illegal activity, threats to any person’s safety or as otherwise required by law;
  • Detect, prevent or otherwise address fraud, security or technical issues; or
  • Protect against harm to the rights, property or safety of Ervin & Smith, our clients or the public as required or permitted by law. We may share aggregated, non-
    personally identifiable information publicly and with our partners – like publishers, advertisers or connected sites. For example, we may share information publicly
    to show trends about the general use of our services. If Ervin & Smith is involved in a merger, acquisition or asset sale, we will continue to ensure the confidentiality
    of any personal information and give affected users notice before personal information is transferred or becomes subject to a different privacy policy.
  • We will share your personal information with third parties only in the ways that are described in this privacy policy. We do not sell your personal data to third parties.

Third-party service providers.

Sometimes we share member information with third-party service providers who help us run our business, such as hosting companies, payment processors and software companies. All service providers we work with have signed a confidentiality agreement and operate under contractual obligation with us. They have no rights to use member information independently and must abide by the terms of this Privacy Policy.
